1. Acceptance of Terms

By accessing and using KennedySMM ("the Platform"), you accept and agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you must not use our services.

These Terms constitute a legally binding agreement between you ("User") and KennedySMM ("Service Provider"). By creating an account, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

Important Notice:

Your use of our services indicates your acceptance of these Terms. We reserve the right to modify these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the modified Terms.

2. Service Description

KennedySMM provides professional Facebook advertising services including:

  • Ad Campaign Creation: Professional Facebook ad setup and optimization
  • Target Audience Selection: Precision targeting based on interests and demographics
  • Campaign Management: Ongoing monitoring and optimization of ad campaigns
  • Performance Analytics: Detailed reporting and campaign performance tracking
  • Manual Payment Processing: Secure top-up and balance management system

We act as an intermediary between users and Facebook's advertising platform. All ads run through official Facebook advertising channels.

3. Account Registration & Security

To use our services, you must register for an account by providing accurate, current, and complete information.

Account Requirements:

  • You must be at least 18 years old
  • Provide valid email or WhatsApp number for verification
  • Create a strong password (minimum 8 characters)
  • Upload a profile picture (avatar)
  • Accept these Terms & Conditions during registration

Security Responsibility: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

Two-Factor Authentication:

We strongly recommend enabling Two-Factor Authentication (2FA) for enhanced account security. KennedySMM provides 2FA via Google Authenticator for added protection.

4. Payment Terms & Refunds

Payment Rules:

Service Fees:

We charge a 15% service fee on all ad campaigns. This fee covers platform maintenance, customer support, and campaign optimization services.

Refund Policy:

No Refunds for Used Credits: Once ad credits are used for campaigns, they are non-refundable. Unused account balances may be refunded at our discretion, subject to a 10% processing fee.

Cancellation Policy: Ad campaigns can be cancelled before they start running. No refunds for campaigns that have already started.

5. Ad Campaign Rules & Approval

Ad Approval Process:

  • All ads are manually reviewed by our admin team
  • Standard approval time: 1-24 hours
  • We reserve the right to reject any ad that violates our policies
  • Ads must comply with Facebook's advertising policies

Prohibited Content:

The following content is strictly prohibited:

  • Illegal products or services
  • Adult content or sexually suggestive material
  • Misleading or false claims
  • Hate speech or discriminatory content
  • Violent or graphic content
  • Unapproved pharmaceuticals or supplements
  • Get-rich-quick schemes

Campaign Performance:

No Performance Guarantees:

While we optimize campaigns for best performance, we do not guarantee specific results, click-through rates, conversion rates, or return on investment. Ad performance depends on various factors including market conditions, ad quality, and target audience.

6. Privacy & Data Protection

Data Collection:

We collect and store the following information:

  • Personal identification information (name, contact details)
  • Account credentials (encrypted passwords)
  • Payment information (transaction references)
  • Campaign data (ad content, targeting preferences)
  • Usage data (login history, platform interactions)

Data Security:

We use industry-standard security measures:

  • Firebase Authentication for secure login
  • Firestore database with security rules
  • Base64 image encoding for secure file storage
  • Regular security audits and updates
  • Two-Factor Authentication option

Data Sharing:

We do not sell or share your personal data with third parties except:

  • As required by law enforcement
  • To process Facebook ad campaigns
  • With your explicit consent

7. Limitation of Liability

To the maximum extent permitted by law, KennedySMM shall not be liable for:

  • Any indirect, incidental, or consequential damages
  • Loss of profits, revenue, or data
  • Campaign performance issues
  • Facebook platform changes or restrictions
  • Third-party actions or service interruptions
  • User errors or misconfigurations

Maximum Liability:

Our maximum liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

Force Majeure:

We are not responsible for delays or failures in performance resulting from acts beyond our reasonable control, including but not limited to: acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor or materials.

8. Account Termination

We may terminate or suspend your account if:

  • You violate these Terms & Conditions
  • You engage in fraudulent activities
  • You use the platform for illegal purposes
  • You repeatedly submit prohibited content
  • You harass other users or our staff
  • Your account remains inactive for 12 months

User-Initiated Termination:

You may request account deletion by contacting support. Upon termination:

  • Your access to the platform will be revoked
  • All pending campaigns will be cancelled
  • Remaining balance may be refunded (minus processing fees)
  • Your data will be anonymized within 30 days

9. Dispute Resolution

Governing Law:

These Terms shall be governed by and construed in accordance with the laws of Nigeria, without regard to its conflict of law provisions.

Dispute Process:

  1. Informal Resolution: Contact our support team first to attempt resolution
  2. Mediation: If unresolved, parties agree to mediation before legal action
  3. Arbitration: Any dispute shall be settled by binding arbitration
  4. Court Action: If arbitration fails, disputes may be brought to court

Class Action Waiver:

You agree to resolve disputes on an individual basis and waive any right to participate in class actions or class arbitrations.
